Illinois HoR doesn’t understand the 2nd Amendment

HOUSE RESOLUTION

WHEREAS, Gun violence is an ever present problem in the  State, as well as nationwide; an example of which is 8 persons dying in Chicago in one week in October due to gun violence; and . . .

Followed by not only a complete misunderstanding of the 2nd Amendment and the writings of the framers behind it [informed largely by the various state constitutions]….but also a sad tantrum at the alleged ‘partisanship of five SCOTUS judges. Apparently ignorant of the same sort of partisanship of the four SCOTUS judges that they agree with.

Specifically, there is no indication that the Framers of the Amendment intended to enshrine the common-law right of self-defense in the Constitution.”

The entire premise behind the Amendment is to protect the pre-existing natural right of self defense. Part of that natural right is the ability to form and arm a militia to oppose State tyranny.

Idiots. But at least they feel better. That’s what counts…..

  1. the 5 member majority of the United States Supreme Court either ignored or misinterpreted much of the clear and plain wording of the Second Amendment;

    The writing could not be any more clear. “The right of the people to keep and bear arms shall not be infringed.” It never ceases to amaze how they think they can twist such clear and simple language.

    pecifically, there is no indication that the Framers of the Amendment intended to enshrine the common-law right of self-defense in the Constitution.”

    I love it when they slip up. There’s the unintentional admission right there, for all to see. It is self defense that they are attacking specifically. We always knew it was true, but now they said it.

    WHEREAS, The Heller decision and other pro-firearm industry court rulings have resulted in a proliferation of guns in numerous communities and have diminished the security and freedom of our citizens to enjoy a life free of gun violence; living with the fear of gun violence is contrary to living in a free society; high levels of gun violence are a threat to the security of whole communities;

    It is highly probable that the authors were thinking of Benjamin Franklin. Trading freedom for the “security” of a government monopoly on force results in neither freedom or security. Israel and Switzerland, where guns are always carried by people, have no gun violence and even violent crime in general is very rare.

    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the courts, especially the United States Supreme Court, to restore interpretation of the Second Amendment as a right afforded to state-sponsored militias that as Justice Stevens stated in his Heller dissent, ” … it does not curtail the Legislature’s power to regulate the non-military use and ownership of weapons … ”

    The gun grabbers love to use “interpretation” because they know that the Founder’s original intent was no infringement.

      This^

      They make this claim ad nauseam….yet consistently fail to provide a shred of evidence where a Framer posits that the RKBA is meant to be restricted to active militia service. They cannot, of course…because the entire weight of historical evidence shows quite the opposite.

  2. Caught some of your “debate” on this topic with RN (a former libertarian) and his new best bud, Octo (the prototypical pompous ass/pseudo- intellectual). I trust that you took a long shower afterwards.

    • He provided entertainment value…that’s his role. I still giggle a bit over the fact that he claims to be well acquainted with the concept of compromise….yet his listed only demands….not giving a thing in return. And he stood by that. Heh.
